Section 55
Medical expenses, compensation, expenses or relief to be provided

(1) If a person suffers any kind of loss or damage due to a train accident, the board shall provide the following amount to such person or in case of death to the next of kin of the deceased for medical expenses, compensation, travel expenses or relief:-
(a) In case of injury to any person, up to one lakh rupees for medical treatment expenses considering the circumstances of the injury,
(b) In case of a person's dismemberment, if he is unable to recover and is unable to work, two hundred and fifty thousand rupees for each member and if such member is dismembered, up to one hundred and fifty thousand rupees for wound expenses, (c) In case of death of a person due to an accident, for medical expenses and relief Seven lakh rupees.
(2) Notwithstanding anything contained in sub-section (1), no amount shall be given for such compensation or relief in case of death or dismemberment of the passenger or if it is confirmed that the passenger has been injured due to any of the following causes:-
(a) The traveler committed suicide. or attempted suicide,
(b) The passenger himself has committed a mistake or misbehavior,
(c) the passenger has committed any criminal act,
(d) the passenger has consumed alcohol or drugs, or
(e) Natural/caused - or the passenger has any disease or has taken any medicine.
(3) In case of loss or damage to the property of a passenger or other third party due to train accident, the amount to be sustained based on the actual loss of the property, shall be paid by the board to the concerned person.
(4) A person who is not satisfied with the decision made by the Board in accordance with this section may file an appeal in the concerned High Court within thirty-five days from the date of receiving the notification of the said decision.
